You may be advising the client at the Police Station stage – or in the Office – or in your local Magistrates’ Court – or in the Crown Court – it is important that you have a general understanding of the position concerning all that has happened in the last 20 years since the implementation of the Sexual Offences Act 2023.

1 – The current position in relation to the interrogation of mobile phones or other devices held by complainants or witnesses or defendants in the proceedings – Case-law – Legislation – Guidance

2 – CONSENT – a bit of a minefield when dealing with sexual offences – do be aware of the rebuttable presumptions concerning consent and the non-rebuttable presumptions concerning consent and the role of alcohol in the area of CONSENT
​
3 – The offences in relation to ‘up-skirting’– amendments to the law on voyeurism
​
4 – The offences in relation to ‘breastfeeding’ – amendments to the law on voyeurism
​
5 – An understanding of Schedules 3 and 5 of the Sexual Offences Act 2003
​
6 – Notification Requirements – the Sex Offender register – Part 2 of the Sexual Offences Act 2003 – Section 82 of the Sexual Offences Act 2003

7 – The crime of sexting – the age in order for it to be lawful
​
8 – The taking of indecent photographs of children

9 – Indecent images generally

10 – Ancillary Sexual Orders under Part 2 of the Sexual Offences Act 2003 – Sexual Harm Prevention Orders (SHPO’s)

14 – Is consent to sexual activity a true consent where there has been the telling of lies by one of the parties? – the interesting case of Regina and Jason Lawrance

16 – Sexual assault – is it an objective or a subjective test? – a question posed to the Court of Appeal by the Attorney General

17 – A consideration of whether or not a belief was reasonably held (in an objective sense) in a consensual but under-age sexual case – Regina v Whitbread

18 – Abuse of a position of trust – the new Section 22A of the Sexual Offences Act 2003 as a result of the Police, Crime, Sentencing and Courts Act 2022

19 – Clients being sentenced under the Dangerous Offender regime for committing sexual offences and clients being deemed to be ‘Offenders of Particular Concern’ for committing sexual offences – an examination of the case of A and Regina

20 – Should the Youth Court accept jurisdiction on serious sexual offences? – the 2023 case of BH and Norwich Youth Court and the CPS
